1. Service

Pecky enables the review of websites and digital products through projects, observations called “pecks,” screenshots, comments, and tracking. It may include a Chrome extension, browser-dependent voice dictation, and connections through Model Context Protocol (MCP), a protocol for connecting artificial intelligence agents to tools.

2. Accounts and security

You must be at least 18 years old and have the legal capacity to enter into contracts to register. You must keep your information accurate, protect your credentials, and keep your email address up to date. Operational, contractual, payment, and deletion notices will be sent to your registered email address and are necessary to provide the Service.

3. Roles and invitations

Projects are private, invitation-only spaces. The Owner manages the project, its members and permissions, and is responsible for its subscription and storage; a Collaborator creates pecks, replies, and modifies their contributions according to their permissions. A Pro subscription does not grant rights over other owners’ projects. The owner may delete an entire project, including collaborators’ contributions, so collaborators should keep copies of anything they need. Invitation links normally expire after seven days; acceptance through an account with a verified email address may remain available while the invitation is pending.

4. Plans and storage

Free allows you to collaborate by invitation and send pecks, comments, and images through the web or Chrome; it does not allow you to create projects or connect MCP agents from that account. For new subscriptions, Pro costs MX$199 per month per owner when Mexico is selected as the billing country and US$15 per month elsewhere and provides projects and collaborators without a numerical limit, MCP, and 1 GB of storage shared across the owner’s projects, including covers and collaborators’ uploads. Each peck supports up to 10 images, with a maximum of 10 MiB per image and 50 MiB per submission. When the storage allowance is exhausted, new images are blocked, but you can continue sending text-only pecks. We will notify the owner when storage usage reaches approximately 80% and 100%. Unlimited projects and collaborators are subject to legitimate use, without abusive automation, resale, attacks, or circumvention of technical limits. Before restricting excessive use, we will provide notice and a reasonable opportunity to correct it, except in urgent security or legal situations.

5. Payments, renewal, and taxes

You choose International or Mexico as the billing region before payment; International is selected by default. Stripe collects and stores your billing address. MX$199 and US$15 are final monthly prices, including applicable taxes. No additional taxes are added at checkout. The selected amount and currency are shown before payment. The selected price remains fixed for renewals; existing subscriptions keep their contracted price. Private discounts may be granted, including complimentary Pro with a 100% discount, under the same access, storage, cancellation, and recovery rules. The amount and currency of the charge are shown before payment. Your bank may apply currency conversion or fees outside Padmit’s control. Stripe processes recurring monthly charges until you cancel. You can manage your subscription and payment methods from your account. The current offering does not include an annual plan, a free trial, or storage add-ons.

6. Cancellation, recovery, deletion, and non-payment

You can cancel Pro from your account. You will keep its benefits until the end of the paid period; your own projects will then become read-only for 30 calendar days. During those 30 days, you can reactivate Pro to prevent deletion and export each project individually as a ZIP file from the pecks section, including project information, pecks with their statuses and available images, and a cover only when it is custom. Before you confirm cancellation, the interface will explain the consequences and ask for your express acceptance, which will be recorded. We will send notices to your registered email address approximately 7 days and 1 day before deletion. Once the 30 days have elapsed, we will automatically delete your own projects and their content from active systems, including collaborators’ contributions; backups will follow their technical purge cycle, and legally required records may be retained. Your account will keep Free access to other owners’ projects. In the event of non-payment, projects may become read-only and you will have up to 21 calendar days from the first unpaid due date to bring payments up to date; after that deadline, Pro will be canceled automatically and the same 30-day recovery and export period will begin. If you cancel while payments are overdue, recovery will begin when cancellation takes effect, without extending the 21-day payment recovery deadline.

7. Refunds

Except for non-waivable rights provided by law, periods that have already started are not refunded for lack of use. For duplicate, incorrect, or unrecognized charges, contact soporte@padmit.com, preferably within 30 calendar days of the charge; we will aim to respond within 10 business days. That timeframe does not limit any applicable legal rights to dispute charges or withdraw.

8. Content and intellectual property

The user or lawful rights holder retains the rights to their text, pecks, images, and screenshots. The user represents that they have permission to share them. The user grants Padmit and the providers operating the Service a non-exclusive, limited license to store, make technical copies of, transmit, back up, and display the content to authorized people for as long as necessary to provide the Service. Padmit will not use that content to train its own AI models without separate authorization; this restriction does not govern the independent processing carried out by AI providers that the user connects through MCP.

9. Screenshots, third-party data, and confidentiality

You must only capture and share websites, images, and data for which you have authorization. If you capture third-party personal data, you are responsible for having a legal basis, fulfilling confidentiality obligations, and keeping your own privacy notice up to date. Avoid sharing passwords, secrets, and unnecessary sensitive data.

10. MCP and AI agents

MCP stands for Model Context Protocol and allows you to authorize AI agents to consult projects, pecks, conversations, and images, and to publish replies or change statuses according to their permissions. Actions taken by an agent are attributed to the account that authorized the connection, without prejudice to third parties’ legal liability. You can revoke connections. The external AI provider may process the information under its own terms and privacy notice.

11. Prohibited uses

You may not use Pecky to infringe third-party rights, gain unauthorized access, distribute malware, phishing, or spam, harass others, circumvent quotas, or overload systems. Report unlawful or infringing content to soporte@padmit.com, providing the project identifier, a description, and available evidence. We will review the report and may request information, restrict access, or remove content where appropriate.

12. Availability and changes

We strive to keep the Service available and secure. Except where a legally required guarantee applies, we do not guarantee uninterrupted operation, a complete absence of errors, universal compatibility, accuracy of AI responses, or commercial results. We may perform maintenance and adopt urgent security measures, without limiting consumers’ non-waivable rights.

13. Account deletion, ownership transfer, and retention

You cannot delete your account while you have an active Pro subscription or own projects that are still subject to the recovery and deletion process in section 6. You can transfer a project to another member who has active Pro and sufficient storage, provided they expressly accept the transfer. Once completed, the project and its storage move to the new owner and are no longer subject to your projects’ scheduled deletion; your contributions retain their authorship, and you remain a collaborator, subject to the project’s permissions. A pending request does not change ownership or suspend deletion deadlines. Deleting an eligible account revokes connections and disables access. Contributions in other owners’ projects may remain with your identity removed, subject to applicable privacy rights. Free accounts that have had no authenticated activity for 24 months may be closed after at least 30 calendar days’ advance notice by email; this does not delete other owners’ projects.

14. Rights in Pecky

Padmit and its licensors retain the rights to Pecky’s software, brand, design, documentation, and proprietary elements. You are granted a limited, non-exclusive, non-transferable permission to use the Service under these Terms. Commercial exploitation or reproduction outside the permitted features and applicable legal exceptions is not authorized.

15. External providers

Pecky uses providers such as Stripe for payments, Resend for email, and DigitalOcean for infrastructure and storage. Voice dictation may depend on the browser or its providers. External services are subject to their own terms where applicable.

16. Liability

To the maximum extent permitted by law, Padmit’s aggregate contractual liability for ordinary claims will be limited to the greater of US$10 or the amount paid by the claiming account during the preceding 12 months. Liability will not be limited for intentional misconduct, gross negligence, consumers’ non-waivable rights, or other cases where the law prohibits a limitation. We will not be responsible for indirect damages that are not legally attributable to us.

17. Third-party claims

If your misuse, infringement of rights, or unauthorized Content results in a third-party claim against Padmit, you will be responsible for reasonable damages and expenses directly attributable to your conduct, to the extent permitted by applicable law and without excluding Padmit’s own liability.

18. Personal data and privacy

Padmit is the controller of registration, authentication, support, and billing data processed for its own purposes. For third-party information that users choose to capture or upload, Padmit may act as a processor on behalf of the responsible user or organization, as applicable. Anyone uploading third-party data must have appropriate authorization and a privacy notice. See the Privacy Notice.

19. Changes to these Terms

We may amend these Terms and publish the current version with its effective date. Ordinary changes may take effect on the indicated date without retroactively affecting acquired rights. Changes to prices or information retention and deletion policies will be notified by email at least 30 calendar days in advance. If you decide to cancel because of those changes, you can export your projects during the recovery period described in section 6. We will request additional consent where required by law.

20. Applicable law and disputes

These Terms will be interpreted under the applicable laws of Mexico. The parties will seek to resolve disputes in good faith. To the extent legally permitted, the courts of León, Guanajuato, Mexico will have jurisdiction, without prejudice to PROFECO’s authority and consumers’ rights to bring claims before the authorities or courts available to them by law.

21. General provisions

If a clause is held invalid, the remaining clauses will continue to apply. Failure to exercise a right does not waive it. Provisions that by their nature should survive termination will do so, including intellectual property, liability, and disputes. The Spanish version prevails. You can consult previous versions on the Terms and Conditions page or request them by emailing soporte@padmit.com.
